Who Plekt is

Plekt is a platform by Let's Connect. As soon as the company behind Plekt is incorporated, you will find its full details here (registered office and company number). Questions about these terms go to info@plekt.be.

What Plekt does

Plekt brings local businesses and content creators together. We show profiles, make matches possible and offer a chat to make arrangements. Plekt is free today: no money moves through the platform. Plekt is not a party to the collaboration itself: the agreement is made between the business and the creator. We facilitate the contact and the execution, you make the deal together.

Who Plekt is for

• You are at least 13. Every collaboration on Plekt is a barter deal today: you get a product, a service, a credit or an experience, never money.
• Businesses register through someone who is legally entitled to represent the company. A business account with team members falls under the responsibility of the company; the owner manages who has access.
• You create one account with correct, up-to-date information and keep your login credentials to yourself. If you notice misuse of your account, let us know right away.

Accepting and changing these terms

You accept these terms when you create your account; we record which version you accepted. We may update these terms. The date at the top shows which version applies, so check it if you want to know whether anything changed. If you do not agree with a change, you can close your account at any time. If you keep using Plekt after that, the new version applies.

Connected social accounts

You can voluntarily connect social accounts to show your reach. If you connect your YouTube account, you agree to the YouTube Terms of Service. Our access to your connected accounts is read-only; we never post, like or follow anything on your behalf. How we process this data is explained in our privacy policy. If you show your reach through a screenshot or a connected account, you guarantee that those numbers are real and yours.

How a collaboration works

A business posts a deal describing what it offers (the reward), what it expects (the number and type of content), who may post and, where relevant, a deadline and a visit moment. A creator applies or is invited and picks a moment within the availability.

• If the business accepts an application (or the creator accepts an invitation), a binding agreement between the business and the creator comes into being: the business provides the described reward, the creator makes the agreed content according to the deal description.
• The creator delivers the content through Plekt. The business reviews the delivery and approves it. If you are not satisfied as a business, discuss that in the chat. If the creator does not show up or does not deliver, the business can record that in the deal.
• If the business does not respond to a delivery within the period Plekt sets for this (currently 7 days), Plekt approves the delivery automatically. The content then becomes visible on Plekt, just as after an approval by the business.
• If the business does not reply to an application within 14 days, the application expires. The creator gets a notification and may apply again for the same deal. If every spot on that deal was already taken, the creator hears that the deal is full. A business that pauses a deal can decline the waiting applications right away.
• If a creator does not reply to an invitation within 14 days, it expires too. The creator gets a reminder after 3 days. If the invitation still expires, the business gets a notification and may invite the creator again. If the deal fills up before the creator replies, the invitation closes right away and the creator gets a notification.
• If no one from a business has been active on Plekt for 14 days, we pause its open deals. They disappear from the listings and the business gets an email. Running collaborations carry on. The business puts its deals back online in one click.
• Arrangements you add in the chat (for example about style or timing) are part of the deal. Set expectations before anyone starts.
• If you repeatedly fail to keep your commitments, this can lead to a warning or suspension (see “Suspension for misuse”).

Collaborations run through Plekt

Plekt brings businesses and creators together and carries the cost of that matching: we build the platform, put you in touch and secure the collaboration (reviews and proof of what was delivered). That is why a collaboration that started through Plekt is also agreed through Plekt and carried out through Plekt.

• Someone you meet through Plekt, you do not knowingly approach outside Plekt for that collaboration in order to avoid Plekt's protection. This applies to the business and to the creator alike.
• This applies to a collaboration between the same parties who found each other through Plekt, during the collaboration and for twelve months after your last contact through Plekt. It does not stop you from collaborating, separately and outside Plekt, with anyone you like.
• If you nonetheless knowingly continue a Plekt-originated collaboration outside Plekt, Plekt may suspend or permanently ban your account.
• In addition, the party that circumvents pays Plekt a fixed compensation of EUR 500 per circumvented collaboration. If the business and the creator do so together, they are jointly and severally liable. This amount is a reasonable advance estimate of Plekt's loss: the costs Plekt incurred to find and match you.
• This works both ways. If Plekt itself culpably fails an equivalent core obligation, Plekt pays you an equivalent fixed amount on the same basis.
• Both parties accept this as a reasonable fixed compensation. A court may reduce the amount if it were manifestly unreasonable in a specific case.

Barter and value

Every deal on Plekt is a barter deal: the reward is a product, service, credit or experience, never money. The business states an honest indicative value in euros for every deal. That value helps creators choose and can be relevant for tax purposes for both parties: compensation in kind is, economically, still compensation. At the creator's request, the business confirms the value of what was provided.

Content, ownership and usage rights

You remain the author of your content. By uploading content you confirm that you made it yourself and hold the rights to it. You also confirm that you are not infringing anyone else's rights: think of music, images or people who appear in it. If you need consent from someone who appears in it, you ask for it.

When you deliver content for a Deal, you give the business you made it for a broad right of use. That right applies worldwide for as long as copyright lasts. You get nothing extra for it: the reward in the Deal covers it. The business may use the content in every form that exists today: on its own socials, on its website, in its shop, in print, in newsletters and in paid ads. It may shorten the content, add subtitles and crop it to another format. It may also add its logo or a text. It may pass this right on to whoever handles its marketing, such as an agency.

In the Deal you agree who posts the content. That choice says who has to post it. It does not limit what the business may do with the content.

The right of use is not exclusive. You may always keep posting your content yourself wherever you like: on your own socials, in your portfolio or on another platform.

You give Plekt the same broad right of use on all content you put on Plekt. Plekt shows it in the feed, on your profile and in your media kit. Plekt may also use it to promote Plekt itself: on our website, on our socials, in ads and in presentations. For that, Plekt may make copies and convert the content to other formats and qualities. The service providers that store and play the videos for us do that too.

Your moral rights as the author stay with you. You do accept the usual edits listed above. You also accept that your name cannot appear everywhere, for example in a short ad. Nobody may change your content in a way that harms your honour or your reputation.

You always upload your content yourself. Plekt never pulls files from TikTok, Instagram or any other platform. What you posted on your own socials, you manage there yourself.

If you delete your account, we remove your profile and your name and your content disappears from your profile and from the feed. The rights of use you gave remain. The business gave something in return and may keep using the content. Plekt does not have to pull ads that are already running. The numbers of that content keep counting towards the business's results. If you want a business to stop using a specific piece of content, contact us. We look at that case by case.

Transparency in advertising

Content you make in exchange for a product, service or credit is a commercial collaboration. The law and the Belgian JEP code for influencers require you to state this clearly with every publication: a label such as “ad”, “advertising” or “paid partnership” in the language of your post, immediately visible, plus a mention of the business (for example a tag). A hidden hashtag or just “#collab” is not enough. The creator is responsible for that disclosure; a business may never ask to hide a collaboration. Also follow the rules of the platform you publish on.

Reviews

After an approved delivery, the business and the creator can review each other. Reviews are about a real collaboration, are honest and respectful and cannot be bought or forced. We can remove reviews that are fake, insulting or clearly misleading.

Tax responsibility

The tax and administrative consequences of a collaboration rest with the users themselves. Whether a barter or payment affects your taxes, your VAT or your social security status depends on your own situation. Plekt gives no advice on this and is not liable when a user fails to meet their tax or social security obligations. If in doubt, consult your accountant or a tax adviser. Where the law imposes obligations on Plekt itself, we comply and tell you about it before we need anything from you.

Rules of conduct

Plekt runs on trust between local businesses and creators. That is why we ask you to:

• show honest information about your business, your profile and your reach;
• keep the arrangements you make in a deal or in the chat;
• communicate respectfully and never intimidate or discriminate against anyone;
• use the chat for what it is meant for, so no spam or unsolicited advertising;
• respect other people's private details and communicate within Plekt;
• not post content that is illegal, defamatory, misleading or harmful or that infringes the rights of others;
• not misuse the platform: no fake accounts, no scraping or data mining, no attempts to bypass security.

Reports and moderation

If you see content or behaviour that is illegal or wrong, report it via the report button or, even without an account, via info@plekt.be. You receive a confirmation and we let you know what we did with your report. Every decision on a report is made by a person; our team can remove content, issue a warning or restrict or suspend an account. Two things do happen automatically and you should know about them. Your chat messages pass through a filter that blocks a phone number or an attempt to move the agreement off Plekt; it blocks the message right away and tells you why, and nobody reads along. And from three warnings onwards, an account is suspended automatically. You can respond to both, see below for how. If we take a measure against you, we tell you which facts and which rule (law or these terms) it is based on and you can respond via info@plekt.be; we review your response and reverse an unjustified measure.

info@plekt.be is also our contact point for users and authorities under the EU Digital Services Act (DSA). You can reach us there in Dutch and English.

Suspension for misuse

If you do not follow the rules of conduct or misuse the platform, we can restrict, suspend or delete your account. In cases of serious misuse we do so immediately. When in doubt, we contact you first to hear your side of the story. A suspension does not change any ongoing obligations between you and your counterparty in a deal.

Right of withdrawal

If you use Plekt as a private individual, you have the consumer right to withdraw from your registration without giving a reason within 14 days of creating your account. You do this by deleting your account via Settings or by emailing info@plekt.be stating that you withdraw your registration. Because Plekt is free, there is nothing to refund.

Termination

You can delete your account yourself at any time via Settings; what happens to your data is explained in the privacy policy. Plekt can discontinue the platform or parts of it or change it substantially; except in cases of force majeure or misuse, we notify you at least one month in advance, so that you can still finish your ongoing agreements.

Plekt is free

Plekt costs nothing today, not for creators and not for businesses. No payments run through the platform: a deal is always a barter deal. If paid plans for businesses are added later, or if paying a creator in money through Plekt becomes possible, you will see the price and the conditions on screen before you confirm anything. Nothing becomes paid silently.

Referring agencies

If you work with a marketing agency or another partner, they can give you a code with which your business signs up to Plekt. If you redeem such a code, your business receives a number of free deal credits once. That is a welcome gift, not a contract with that agency: you owe them nothing through Plekt and they cannot work in your business page, post deals or read your conversations.

One thing you should know: the agency can see, on a status page of its own, which businesses used its code, including the name of the business, the municipality, the date and whether the redemption was approved. It sees nothing beyond that.

A code applies once per business and once per login and we can refuse a redemption or deactivate a code if it is misused, for example by creating businesses that do not really exist. Credits expire one year after they are granted and cannot be exchanged for money. As long as Plekt is free you do not need credits: they only do something once paid plans exist.

Liability

We do our best to keep Plekt safe, available and reliable, but we provide the platform as is and cannot guarantee that it always works flawlessly or without interruption or that an agreement between a business and a creator ends well. The content, the products provided and compliance with agreements are the responsibility of the users themselves.

Except in cases of intent or gross negligence or where the law does not allow a limitation, Plekt's total liability is limited to what you paid Plekt in the twelve months before the damage occurred or to 250 euros if that is more. This text explains how we work and is not legal advice.

Applicable law and disputes

These terms are governed by Belgian law. If something goes wrong, contact us first via info@plekt.be; we try to resolve every dispute amicably first. If that fails, the Belgian courts have jurisdiction; if you are a consumer, you can always turn to the court of your own place of residence. These terms are drawn up in Dutch. Only the Dutch version is legally binding and this English translation is provided for information only.
